By participating in paddle board or kayak activities at Arbutus Cove Retreat, you acknowledge and agree to the following terms and conditions. This waiver and disclaimer must be agreed to before booking your equipment.

1. Assumption of Risk

I understand and accept that paddle boarding and kayaking are water-based activities that involve inherent risks, including but not limited to:

• Falling into the water.
• Capsizing or overturning.
• Collisions with other vessels or objects.
• Adverse weather conditions, currents, tides, or other natural hazards.
• Injuries from improper use of equipment or physical exertion.

I voluntarily assume all risks associated with these activities and agree that participation is at my own discretion and judgment.

2. Release of Liability

I hereby release, discharge, and hold harmless Arbutus Cove Retreat, its owners, employees, and agents from any and all claims, liabilities, damages, or expenses arising from or related to my participation in paddle board or kayak activities, including but not limited to:

• Personal injury or illness.
• Property damage or loss.
• Death or other unforeseen events.

This release applies even if such claims arise from the negligence of Arbutus Cove Retreat or its representatives.

3. Equipment Use and Responsibility

• I acknowledge that I am responsible for inspecting all equipment prior to use and ensuring it is in good working order.
• I will follow all safety guidelines provided by Arbutus Cove Retreat, including wearing a properly fitted personal flotation device (PFD) at all times while on the water.
• I agree to return all equipment in the same condition it was provided, subject to reasonable wear and tear. I accept financial responsibility for any loss or damage to the equipment caused by misuse, neglect, or improper handling.

4. Health and Fitness Certification

I certify that I am physically fit and have no medical conditions that would impair my ability to safely participate in paddle boarding or kayaking. If I have any concerns about my health, I will consult with a medical professional before participating.

5. Age and Supervision

• I confirm that I am at least 18 years of age or have parental/guardian consent to participate.
• Minors under the age of 18 must be accompanied and supervised by an adult at all times while engaging in paddle board or kayak activities.

6. Compliance with Local Laws

I agree to comply with all applicable local laws, regulations, and guidelines while participating in paddle board or kayak activities, including respecting wildlife and other waterway users.

7. Acknowledgment of Weather and Ocean Conditions

I understand that weather and ocean conditions can change rapidly and may impact the safety of paddle boarding or kayaking. I agree to:

• Check local weather and tide conditions before participating.
• Cease activity if conditions become unsafe.
• Follow all instructions and warnings provided by Arbutus Cove Retreat staff.

8. Indemnification

I agree to indemnify and hold harmless Arbutus Cove Retreat from any and all claims, demands, or causes of action brought by third parties arising out of my participation in paddle board or kayak activities.

9. Agreement to Terms

By booking my stay at Arbutus Cove Retreat and participating in paddle board or kayak activities, I acknowledge that I have read, understood, and agreed to this waiver and disclaimer. I confirm that I am voluntarily participating and accept full responsibility for my actions.

Electronic Signature and Agreement

By checking the box during the booking process, I acknowledge that I have read and agreed to the terms of this waiver and disclaimer. My electronic agreement will serve as a legally binding signature.
