By participating in paddleboarding or kayaking activities at Arbutus Cove Retreat, you acknowledge and agree to the following terms and conditions. This waiver and disclaimer must be agreed to before booking your equipment.

Health and Safety

• I understand that paddleboarding and kayaking are water-based activities that carry inherent risks. I will take full responsibility for my health and safety while participating.
• I acknowledge that individuals with certain medical conditions (e.g., heart conditions, respiratory issues, or pregnancy) should consult a doctor before engaging in these activities.

Supervision

• I agree to supervise my children at all times while they participate in paddleboarding or kayaking and ensure they follow the provided safety guidelines.
• Minors under 18 must be accompanied by an adult while on the water.

Equipment Use and Responsibility

• I acknowledge that I am responsible for inspecting all equipment before use and ensuring it is in good working condition.
• I will wear a properly fitted personal flotation device (PFD) at all times while on the water.
• I agree to return all equipment in the same condition it was provided, subject to reasonable wear and tear. I accept financial responsibility for any loss or damage due to misuse or neglect.

Weather and Ocean Conditions

• I understand that weather and ocean conditions can change rapidly and impact safety.
• I agree to check local weather and tide conditions before participating.
• I will immediately cease activity if conditions become unsafe.
• I will follow all safety instructions and warnings provided by Arbutus Cove Retreat staff.

Etiquette and Respect for Others

• I agree to respect the privacy and enjoyment of other guests and waterway users.
• I will avoid excessive noise, act responsibly, and be mindful of marine wildlife and environmental regulations.

Compliance with Local Laws

• I agree to comply with all applicable local laws and regulations while participating in paddleboarding or kayaking.
• I will respect wildlife, waterway rules, and the rights of other paddlers and boaters.

Maintenance and Availability

• I understand that paddleboarding and kayaking equipment is subject to maintenance and may not always be available for use.
• I acknowledge that Arbutus Cove Retreat reserves the right to restrict access due to weather, safety concerns, or necessary repairs.

Assumption of Risk and Liability Waiver

• I assume full responsibility for any risks associated with paddleboarding and kayaking, including but not limited to:
  • Falling into the water.
  • Capsizing or overturning.
  • Collisions with other vessels or objects.
  • Adverse weather conditions, tides, or currents.
  • Injuries from improper use of equipment or physical exertion.
• I release Arbutus Cove Retreat, its owners, employees, and agents from any claims, liabilities, or damages arising from my participation, including personal injury, property damage, or loss.

Agreement to Terms

• By booking my stay at Arbutus Cove Retreat and participating in paddleboarding or kayaking, I acknowledge that I have read, understood, and agreed to this waiver and disclaimer. I confirm that I am voluntarily participating and accept full responsibility for my actions.

Electronic Signature and Agreement

• By checking the box during the booking process, I acknowledge that I have read and agreed to the terms of this waiver and disclaimer. My electronic agreement will serve as a legally binding signature.
